Defendant was charged with one count of second-degree murder and one count of third-degree murder in the September 6, 1976, shooting death of George Carlson in St. Paul. A Ramsey County District Court jury found defendant guilty of the lesser of the two offenses and the court sentenced him to a term of 3 to 25 years in prison, Minn. St. 609.11 and 609.195. On this appeal from judgment of conviction defendant contends (1) that the evidence of his guilt was legally insufficient, (2) that the trial court erred in denying a pretrial motion to limit the prosecutors impeachment of defendant by prior conviction, with the result that defendant was compelled to forego testifying in his own behalf, (3) that the trial court denied defendant a fair trial by injecting himself into the trial in an improper manner, and (4) that the trial court erred in its instructions on the issue of self defense. We reverse and remand for a new trial.
